Prism Fine Wine LLC (DBA Prism Fine Wine) – this North Carolina entity is a licensed Wine Retailer in the State of North Carolina with a registered address of:

herein called “Prism Fine Wine” and for all intents and purposes is the seller of record, subject to the following terms and conditions

Prism Fine Wine sells wine subject to the following terms and conditions. By placing an order with Prism Fine Wine, the buyer agrees to the following:
 

Age Verification
All customers assert and affirm that they are at least 21 years old. Prism Fine Wine retains the right to use reasonable means to verify a buyer's age and reserves the right to refuse to sell or deliver wine to anyone. All shipments require that the carrier verify the age of the recipient before delivery. In most locations, it is illegal for anyone under the age of 21 to attempt to purchase alcohol. Prism Fine Wine will comply with any legal entity in the prosecution of anyone under the age of 21 attempting to buy alcohol.


Location of Sale
Title to, and ownership of, all wine passes from seller to buyer in the State of North Carolina, and buyer takes all responsibility for shipping the wine from North Carolina to his or her home state. By placing an order, buyer authorizes seller to act on buyer’s behalf in arranging for transportation of the wine at the buyer’s direction. Prism Fine Wine makes no representation as to the legal rights of anyone to ship or import any wines, alcoholic beverages or other goods into any state. The buyer warrants that he or she is solely responsible for the shipment of wine and other goods purchased and for determining the legality and the tax/duty consequences of having the wine and other goods shipped to the applicable destination.

Shipping
There are times of the year where shipping wine across the US is inherently risky due to extreme hot or cold temperatures or other natural weather events. We understand you want your wine ASAP, but we are more than happy to hold orders until weather conditions improve.

Shipping carriers do not insure for weather damage to wine, so if you choose to ship, we ask that you sign the “Prism Fine Wine LLC Shipping Weather Waiver” and Prism Fine Wine shall be released from any liability relating to any and all damage due to shipping during extreme weather conditions. Please note this includes any unforeseen delays that may occur during the shipping process. Prism Fine Wine will endeavor to follow specific shipping instructions and delivery windows. Such instructions should be indicated at the time of purchase.

International shipping estimates at time of checkout are subject to change. Prism Fine Wine will be in contact to make necessary arrangements and provide finalised shipping charges


Shipping Address
A street address at which an adult over 21 years of age or older is available during daytime hours to receive wine is required. Due to carrier restrictions, we cannot ship to a PO Box. Sometimes an order is returned to our store after several delivery attempts at the address provided by the customer. We are happy to reship the order however, reshipment fees will apply. Please contact us and we will assist you with the reshipment arrangements. We advise shipping to a local FedEx access point or FedEx Office store to minimize these type of issues.


Order Cancellation
If you make an error in ordering, please contact us immediately. There is a 5% fee for any order cancelled after the credit card batch has run (usually the evening of the same day). Orders that are completed and shipped to an address outside of the United States are not cancellable or refundable for any reason.


Representation of Suitability
While Prism Fine Wine inspects each bottle of wine that it sells and endeavors to describe each bottle that it does not deem to be in excellent condition that might affect its drinkability, certain spoilage mechanisms are undetectable. Prism Fine Wine makes no specific representation of drinkability of any particular bottle of wine. Prism Fine Wine makes no representation of the suitability of any particular bottle of wine as an investment or for any other purpose.


Availability and Pricing
Prices and availability are subject to change without notice. Due to variations in condition and sourcing, different bottles of the same wine may occasionally be posted with different prices. Due to the real time nature of our website, items are not removed from our inventory until after successful 'check out'. Invoices, verbal and email confirmation notwithstanding, no item is guaranteed to be available until it has been pulled for shipping.


Errors
Prism Fine Wine works hard to accurately describe all products and provide great service in all aspects of its operation. Please contact us immediately if you believe an error has occurred and we will attempt to rectify it or reach an amicable arrangement. Our maximum liability in any circumstance is limited to the purchase price of an item.
